ascds contract terms page

These are contract terms for software development for our customers. All ascds company system software offered for sale are copyright protected and solely owned by ascds company, only. Any custom development made to such systems will not nullify or void ascds company ownership of ascds software, ascds software copyright; or terms of use to the customer. All custom development to ascds company software occurs as 3010 and PLC50 contract terms.

The "cost layer" approach is intended to give contractees the opportunity to adjust their operations to do what is deemed the most cost-effective activity strategically, given the market and internal conditions. The price per hour as reflected on a minute by minute basis (price per hour/60) on the contractor's work-log is the highest layer of cost allowed charged to the contractee according to the contractor.

The cost features shown below do not include the cost of purchased software or other costs associated with labor such as time and a half for hours over 40 per week, double time pay for holidays, or other negotiated charges. The prices shown are subject to negotiation. For example, PLC250 contract terms for 'certification-required' work may be negotiated to having contractee pay for the contractor's certification and allowing time for the certification process. In return, the contractor may then agree to a lower price per hour that is further based on terms of the respected parties' copyright ownership statuses of software developed under contract.
Cost layers Price per hour
3010 is the cost layer that sets the minimum number of hours a contractor may work under contract. This number is 30 hours per week. When no other terms apply, this is the basis for payment by the contractee. Strategically, the contractee stands to gain the most by minimizing this level of cost to him/herself by providing the contractor with all the necessary resources to move into a productive level of cost (one or more of the PLCs), where throughput gains offset costs associated with a given PLC. $10.00
PLC50 is the cost layer that involves a contractor working actively in either administrative activities[1]; or in development of systems deemed copyright protected and resalable property of contractor's company, only. Contractee's use of property does not include resale of it. $50.00
PLC100 is the cost layer that involves a contractor working actively in either contract dispute resolution[2] with contractee; or in development of systems deemed copyright protected and resalable property of both the contractor's company, and contractee's company. Both parties' use of property includes resale of it. $100.00
PLC250 is the cost layer that involves a contractor working actively as either a 'certification-required' [3] agent to the contractee; or in development of systems deemed copyright protected and resalable property by only the contractee's company. Contractor's use of property does not include the resale of it. $250.00
[1]: Administrative functions include familiarization and orientation activities, writing reports, keeping daily logs, reading and responding to email, etc.
[2]: Contract dispute resolution includes all time neccessary to resolve labor disputes, legal processes, etc.
[3]: 'Certification-required' is any and all neccessary credentials required by the contractee such as 'Microsoft-certified', etc. that are beyond the credentials BSCS, MEngMgt, and CertProjMgr.
